Consumer Health Data Privacy Notice
Last updated: August 6, 2026 · Effective date: August 6, 2026
This notice supplements our Privacy Policy (dafne.care/privacy) and provides the disclosures required by state consumer health data laws, including the Washington My Health My Data Act and Nevada SB 370. It applies to "consumer health data" as defined by those laws — personal information that identifies your past, present, or future physical or mental health status — that we collect through the Platform and that is not otherwise governed by HIPAA. Information created or received by your provider in connection with your care is governed by the Notice of Privacy Practices (dafne.care/notice-of-privacy-practices).
Consumer health data we collect
Depending on how you use the Platform, we collect: information you provide during signup and intake, including questionnaire responses about your mental health, health history, medications, and therapy goals; information about your use of health-related features of the Platform, such as appointments booked; communications you send us that contain health information; and inferences we may draw from the above to match you with a licensed therapist. We collect this information directly from you and from your use of the Platform.
How we use it
We use consumer health data to: create and manage your account; match you with a licensed therapist and enable your care; maintain safety, including surfacing intake responses to licensed clinicians for review; process payments and provide support; comply with legal obligations; and improve the Platform using de-identified or aggregated data that cannot reasonably identify you.
How we share it
We share consumer health data with: your therapist and provider, to deliver your care; service providers and contractors acting on our behalf under contractual confidentiality obligations (such as hosting, communications delivery, and payment processing); parties to a corporate transaction, subject to this notice and applicable law; and government authorities or other parties where required by law or legal process, or to protect the rights, safety, or property of users, the public, or the Platform. A list of the categories of third parties and affiliates with whom we share consumer health data is available on request at help@dafne.care.
What we do not do
We do not sell consumer health data. We do not share consumer health data with third parties for their own marketing purposes. We do not use advertising technologies on pages where you sign up, complete questionnaires, or receive care.
Your rights
Where these laws apply to you, you have the right to: confirm whether we are collecting, sharing, or selling consumer health data about you and to access that data, including a list of third parties with whom we have shared it; withdraw consent to our collection and sharing of your consumer health data; and have your consumer health data deleted. To exercise these rights, email help@dafne.care or use the Privacy Choices page (dafne.care/privacy-choices). We will verify your identity and respond within the time required by applicable law. We will not discriminate against you for exercising your rights. If we decline a request, you may appeal by replying to our response; if your appeal is denied, you may contact the Attorney General of your state (Washington residents: www.atg.wa.gov/file-complaint).
